The Fifth District Court of Appeals
In Florida, family law appeals are made from the family courts to the court of appeals of their district. The next level of appeal is the Florida Supreme Court, but very few family law cases ever reach that court.
The Fifth District includes the Orlando Metro area, which is the service area of AAA Family Law for trial court cases. Therefore this district court is where AAA Family Law appeals its trial court cases when that is deemed appropriate. But the Fifth District covers a larger area than Orlando Metro. It includes the counties of Orange, Osceola, Volusia, Flagler, Putnam, St. Johns, Lake, Marion, Sumter, Citrus, Hernando, Brevard and Seminole. It is located at 300 South Beach Street Daytona Beach, FL 32114.
This court of appeals has ten judges and, as in all of the other Florida appeals courts, three of these judges sit for each case. For more information see Florida Fifth Court of Appeals.
As explained on What Can Be Appealed in Family Law Cases, these appeals have to be based on the content of: (a) final court orders, (b) child time-sharing orders or (c) non-final orders, by claiming that the trial court applied the wrong law or violated due process rights. In other words, a court order cannot be appealed until it is final, unless it meets the conditions of (b) or (c).
Other Florida District Courts of Appeals
Florida has five district courts. A quote from their website Florida District Courts of Appeal explains their functions:
“The fundamental reasons for appeals from trial courts are to correct harmful errors by having review by a multi-judge panel of experienced judges and to promote clarity and consistency in the law by publishing opinions that set forth the relevant facts of the case and the proper application of the law to those facts.”

- Most family law attorneys prefer not to handle appeals of their own cases. Due to the small number of these and the very different procedures and skills required in them, they find that their time is best used concentrating on trial court cases, particularly if they also take cases outside of family law. However, our attorney, Eduardo C. Mejias, is devoted exclusively to family law, has already completed twelve appeal cases and is working on others. He is very knowledgeable with the procedures of appeals courts and finds helping clients in appeals cases very satisfying.
- Family law appeal cases are handled by exchanging documents through postal mail and email between the lawyer and the court. They generally do not require the lawyer or the litigating parties to be present in the courtroom.
